The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Rebecca S. Murray Supervisor ofR ecords September 10, 2018 SPRlS/1284 Gerry Panuczak Duxbury Public Schools 93 Chandler Street Duxbury, MA 02332 Dear Mr. Panuczak: I have received the petition of Margaret Monsell appealing the nonresponse of the Duxbury Public Schools (School) to his request for public records. G. L. c. 66, § 1O A; see also 950 C.M.R. 32.08(1). Specifically, Ms. Monsell requested "a copy of any contract currently in force between the School District and any private vendor that the School District has engaged for the provision of food services for students," "any other agreements, memoranda of understanding of other documents governing the practices to be followed by the private vendor in circumstances where (a) a student is unable to pay for the cost of a meal or (b) the vendor claims that a student has received a meal for which payment has not yet been made," "a copy of any debt collection policy that the School District has for school meal debt," "a copy of any contracts currently in force that the School District has with any other entities engaged in collect school meal debt on its behalf, including but not limited to collection agencies, attorneys and constables," "a copy of any contracts currently in force that the School District has with any vendors that provide online management of funds paid on behalf of students for food services, including but not limited to these vendors: MySchoolBucks and PayForit." Having not yet have received a response, Ms. Monsell petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that a representative from the School is working to compile the requested records and intends on providing Ms. Monsell with a written response. Said response must be made in accordance with the Public Records Law and its Access Regulations within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Ms. Monsell may appeal the substantive nature of the District's response within ninety days.
