Murray Supervisor ofR ecords __ September_21,2018 SPR18/1359 Darlene Pernice 20 Murray Hill Park Malden, MA 02148 Dear Ms. Pernice I have received your petition appealing the response of the Board of Registration in Medicine (Board) to your request for public records. G. L. c. 66, § 1O A; see also 950 C.M.R. 32.08(1). Specifically, you requested "all correspondence, documentations and emails, internal and external pertaining to [a n identified individual] during the time frame of January O1 , 1993 to July 25, 2018." The requirements for an appeal are as follows: Such appeal shall be in writing, shall include a copy of the letter by which the request was made and, shall include a copy of all correspondence from the custodian. The Supervisor shall accept an appeal only from a person who had made his or her record request in writing. An oral request, while valid as a public record request pursuant to 950 C.M.R. 32.06(1)(a), may not be the basis of an appeal under 950 C.M.R. 32.08. See 950 C.M.R. 32.08(l)(g). Your petition indicates you were provided redacted records and specifically takes issue with the Board's basis for redaction. Although you provided this office with a cover letter from the Board, the responsive records provided to you were not included in your petition. Given that a copy of the records provided to you by the Department was not included with your petition, we are unable to assist you in this appeal at this time.
