Department of State Police 470 Worcester Road Framingham, MA 01702 Dear Attorney Migliaccio: I have received the petition of Brian O' Connor appealing the nonresponse of the Office of the Department of State Police (Department) to a request for public records. G. L. c. 66, § 1 OA; see also 950 C.M.R. 32.08(1 ). Specifically, Mr. O'Connor requested "work files of certain troopers and/or all Department files since 2006 regarding all background checks of an identified Department employee for a position as a dispatcher and as a Department trooper." Upon review of this matter, it appears the issues raised in this appeal are similar to those addressed in SPRl 8/1085. See SPRl 8/1085 Determination of the Supervisor of Records (September 26, 2018). In my September 26th determination, I closed SPRl 8/1085 with the understanding the Department had met its burden in withholding the background investigation records under the personnel clause of Exemption (c) and Exemption (f). In light of the similarities between SPRl 8/1085 and the present appeal, my October 15th determination shall serve as the determination for SPR18/1455 as well. Sincerely, Rebecca S.
