Legal Counsel Massachusetts State Police Crime Laboratory 470 Worcester Road Framingham, MA 01702-5351 Dear Attorney Kelly: I have received the petition of Christi Berry appealing the nonresponse of the Department of State Police Crime Laboratory (Department) to a request for public records. G. L. c. 66, § lOA; see also 950 C.M.R. 32.08(1). Specifically, Ms. Berry requested "all commutation log and note between the crime lab and the district attorney office as well as the Worcester Police Department in all aspects pertaining to [an identified individual]." Claiming to not yet have received a response, Ms. Berry petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that a representative from the Department has provided Ms. Berry with some of the requested records and intends on providing Ms. Berry with a written response. Accordingly, the Department is ordered to provide Ms. Berry with a response within ten business days. Said response shall be made in accordance with the Public Records Law, its Access Regulations and this order. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Ms. Berry may appeal the substantive nature of the Department's response within ninety days.
