Assistant General Counsel Department of Conservation and Recreation 251 Causeway Street Suite 600 Boston, MA 02114 Dear Attorney Connelly: I have received the petition from Glen Ayer appealing the nonresponse of the Department of Conservation and Recreation (Department) to a request for public records. G. L. c. 66, § 1 OA; see also 950 C.M.R. 32.08(1). Specifically, Mr. Ayer requested various records "related to the proposed 'Brook Road Timber Sale' in Wendell State Forest." Claiming to not have received a response from the Department, Mr. Ayer petitioned the Supervisor of Records and SPR18/1473 was opened as a result. Subsequent to the intervention by a member of the Public Records Division staff, this office was notified that a response was provided, dated October 15, 2018. Whereas this matter was opened based upon the Department's failure to provide a written response, I will now consider this administrative appeal closed. Mr. Ayer may appeal the substantive nature of the Department's response within ninety days. See 950 C.M.R. 32.08(1). Sincerely, ~ Rebecca S.
