Murray Supervisor ofR ecords October 30, 2018 SPR18/1520 Savyon Cohen Via email: savyonl@aol.com Dear Ms. Cohen: I have received your petition appealing the response of the Town of Brookline to your request for public records. G. L. c. 66, § lOA; see also 950 C.M.R. 32.08(1). Specifically, you requested "all correspondence, meeting minutes and summaries, and legal bills/receipts related to the subpoenas of [three identified individuals]." The requirements for an appeal are as follows: Such appeal shall be in writing, shall include a copy of the letter by which the request was made and, shall include a copy of all correspondence from the custodian. The Supervisor shall accept an appeal only from a person who had made his or her record request in writing. An oral request, while valid as a public record request pursuant to 950 C.M.R. 32.06(1)(a), may not be the basis of an appeal under 950 C.M.R. 32.08. See 950 C.M.R. 32.08(l)(g). Your petition indicates you were provided redacted records and specifically takes issue with the Town's basis for redaction. Although you provided this office with some responsive emails from the Town, all responsive records and related correspondence from the Town were not included in your petition. Subsequent to the intervention of a Public Records Division staff attorney, I learned the Town has provided you with additional responsive records and an attorney-client privilege log. Given that a copy of all the correspondence provided to you by the Town was not included with your petition, we are unable to assist you in this appeal at this time. Please feel free to resubmit your appeal when you have retrieved copies of all the required documents.
