Assistant General Counsel Department of Conservation and Recreation Boston, MA 02 11 4 Dear Attorney Connelly: I have received the petition of Elizabeth Foster appealing the nonresponse of the Department of Conservation and Recreation (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, Ms. Foster requested various categories of records concerning a complaint she filed about a "hazardous condition on the land within the state park of Wachusett Mountain, in the leased area of Wachusett Ski Area, managed by Wachusett Mountain Associates." Subsequent to the intervention by a staff member of the Public Records Division, I learned that you sent Ms. Foster a letter on October 16, 20 18 stating, "DCR requires additional time to process this production. DCR currently expects to produce responsive records within five (5) business days." As of the date of this letter, it is my understanding that the Department has not provided Ms. Foster a response to her request for records. Order Accordingly, the Department is ordered to provide Ms. Foster with a response to the request, provided in a manner consistent with this order, the Public Records Law and its Regulations without delay.
