Dear Ms. Scanlan:

I have received the petition of Michael Dreslinski appealing the nonresponse of the Executive Office of Health and Human Services (Office) to his request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, Mr. Dreslinski requested “All Tort Claims Act presentment/claim letters (G.L. c. 258, §4) received between 09-01-2017 through 09- 01-2018,” and “All responses made to above referenced Tort claims.”

Subsequent to the intervention by a staff member of the Public Records Division, I learned that a representative from the Office is working to compile the requested records and intends on providing Mr. Dreslinski with a written response. Said response must be made in accordance with the Public Records Law and its Access Regulations within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr.

Dreslinski may appeal the substantive nature of the Department’s response within ninety days. See 950 C.M.R. 32.08(1).
