Murray Supervisor ofR ecords November 7, 2018 SPRlS/1588 Carol Szocik Massachusetts Department of Agricultural Resources 251 Causeway Street, Suite 500 Boston, MA 02114-2151 Dear Ms. Szocik: I have received the petition of Michael Dreslinski appealing the nomesponse of the Massachusetts Department of Agricultural Resources (MDAR) to a request for public records. G. L. c. 66, § lOA; see also 950 C.M.R. 32.08(1). Specifically, Mr. Dreslinski requested five categories of records related to "a former civil action filed in Suffolk Superior Court in which the Department of Agriculture was named as a defendant." Claiming to not yet have received a response, Mr. Dreslinski petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned MDAR had attempted to send Mr. Dreslinski the request but the mailed item came back as undeliverable. Nonetheless, after MDAR was made aware of this appeal and received his correct address, a representative within MDAR noted their willingness to provide a response. Accordingly, MDAR is ordered to provide Mr. Dreslinski with a response within ten business days. Said response shall be made in accordance with the Public Records Law, its Access Regulations and this order within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Dreslinski may appeal the substantive nature of MDAR's response within ninety days. See 950 C.M.R. 32.08(1).
