G. L. c. 66, § 1O A; see also 950 C.M.R. 32.08(1). Specifically, Mr. Hayes requested four incident reports. Unsatisfied with the Department's response, Mr. Hayes petitioned trus office and SPRl 8/1600 was opened as a result. Current Appeal In a letter dated September 26, 2018, Mr. Hayes states," I asked for four partial incident reports and you sent me all four but ... you omit report 119106 from your letter of 9/14/2018." In response, the Department provided Mr. Hayes all four incident reports on November 2, 2018. In the Department's November letter, you write, "[p]lease accept trus letter as a revision to the 2nd response to the 10/26/2018 request. Reports 125362, 128004, 14099 & 119106 have all been enclosed again for your review." Conclusion In light of the Department's November letter to this office, I will now consider trus 2nd administrative appeal closed. Mr. Hayes may appeal the substantive name of the Department's response within ninety days. See 950 C.M.R. 32.08(1).
