. Dear Ms. Caron:

I have received the petition from Attorney Paul Machado appealing the nonresponse of Fall River Public Schools (School) to a request for public records. G. L. c. 66, § 10A; see also 950 C.MLR. 32.08(1). Specifically, Attorney Machado requested public records “the number of times the Fall River School Department has initiated expulsion proceedings pursuant to GL Ch 71 s 37H % for the period beginning January 2016 to the present. For each occasion that the Fall River School Department has initiated such expulsion proceeding, specify the number of appeals to the Superintendent for the same period of time, January 2016 to the present. For each appeal to the Superintendent, specify the following: 1. The number of appeals overturning the expulsion, suspension order; 2. The number of appeals supporting the expulsion, suspension order.”

Subsequent to the intervention by a member of the Public Records Division staff, this office was provided with a response from the School on November 16, 2018 which was also provided to Attorney Machado. Whereas this matter was opened based upon the School not providing a written response, I will now consider this administrative appeal closed. Attorney Machado may appeal the substantive nature of the School’s response within 90 days. See 950 C.M.R. 32.08(1).
