Box 807 20 Manning Avenue Middleton, MA 0 1949 Dear Mr. Raynard: I have received the petition of David Tuttle appealing the nonresponse of the Essex County Sheriffs Department (Department) to a request for public records. G. L. c. 66 5 10A; see 950 C.M.R. 32.08(1). Specifically, Mr. Tuttle requested various documents containing information about the Essex County Sheriffs Department's budget and expenditures in the fiscal year 2018. Having received no response, Mr. Tuttle petitioned this office. Under the Public Records Law and the Access Regulations (Regulations) all requests for public records must be met with a response within ten business days of receipt of the request. G. L. c. 66, 5 1O (a)-(b). The response may contain, among other things, an offer to provide records, a fee estimate for provision of the records, or a denial. G. L. c. 66, 5 1O (b). All records custodians must comply with both the Public Records Law and the Regulations with respect to the timeliness of response. Subsequent to the intervention by a member of the Public Records Division, you informed this office on November 20,201 8 that the Department is working on a response to the request. Accordingly, the Department is ordered to provide said response in a manner consistent with this order, the Public Records Law, and its Regulations within 10 business days. Mr. Tuttle may appeal the substantive nature of the Department's response within 90 days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S.
