Massachusetts Department of Transportation 10 Park Plaza, Suite 3510 Boston, MA 02116 Dear Attorney Doyle: I have received the petition of Andrew Crouch appealing the nonresponse of the Massachusetts Department of Transportation (Department) to his request for public records. G. L. c. 66, § lOA; see also 950 C.M.R. 32.08(1). Specifically, Mr. Crouch requested "[a]ll records or communications, whether written or electronic, between the Massachusetts Department of Transportation and the Castle Island Brewing Company, its agents or employees, or the City of Boston regarding Castle Island's requests or attempts to build a beer garden or seek an alcohol license and other related permitting, in the City of Boston. This request is limited to July 1, 2017 through August 1, 2018." Subsequent to the intervention by a staff member of the Public Records Division, this office received an email, which was also sent to Mr. Crouch, indicating that you are working to compile the requested records and intends on providing Mr. Crouch with a written response. Said response must be made in accordance with the Public Records Law and its Access Regulations within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Crouch may appeal the substantive nature of the Department's response within ninety days.
