Ihave received t}ie petition of Kenneth Lefebvre appealing the response of the City of Holyoke Gas & Electric Department (Department) to a request for public records. G. L. c. 66, lOA; see also 950 C.M.R. 32.08(1). Specifically, Mr. Lefebvre requested: "General availability and service coverage map for the City of Holyoke's fiber optic internet service within the [cities] of Holyoke, Springfield, Chicopee and any surrounding communities which the [Department] provides internet services to. This map can be in the form of a standard image format such as (JPG; PNG; SVG; BMP; etc.) PDF or otherwise a map file (GIS, etc.) provided it indicates where within the network municipalities such coverage, or potential for coverage (with installation) exists." The Department provided Mr. Lefebvre with a telecom availability diagram. In an October 23rd email Mr. Lefebvre stated, "[a]s I indicated in my request, I am looking for a map that shows coverage within those communities cited in your PDF. I am looking for coverage as it exists, and where it may be readily installed based on the specific fiber lines within the city." After not receiving a response to his follow-up email, Mr. Lefebvre petitioned the Supervisor of Records (Supervisor), and this appeal was opened. On November 14t\ the Department explained it has no records regarding the cities of Springfield or Chicopee; therefore, Mr. Lefebvre would need to make a request directly to those cities. By email on November 16th, the Department provided Mr. Lefebvre with the only fiber optic coverage map of Holyoke that exists, waiving all fees in doing so. As a result, Mr. Lefebvre notified a Public Records Division staff attorney that he is satisfied and would like to close this appeal. Accordingly, I will consider this appeal closed.
