Box 35 Edgaiiown, MA 02539 Dear Ms. Williams: I have received the petition of Pat Kager appealing the nonresponse of the Edgartown Town Clerk (Town) to a request for public records. G. L. c. 66, § 1O A; see also 950 C.M.R. 32.08(1). Specifically, on November 11, 2018, Mr. Kager requested nine categories ofrecords pe1iaining to Waste Water Commission/Commissioners, including email correspondence between certain named individuals. Claiming to not yet have received a substantive response, Mr. Kager petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I leamed that a representative from the Town Administrator's office is working on the records request. Accordingly, the Town is ordered to provide Mr. Kager with a response without delay. Said response shall be made in accordance with the Public Records Law, its Access Regulations and this order within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Kager may appeal the substantive nature of the Town's response within ninety days.
