Assistant General Counsel Suffolk County Sheriffs Department 200 Nashua Street Boston, MA 02114 Dear Attorney Romero: I have received the petition from William McDonagh appealing the nonresponse of the Suffolk County Sheriffs Department (Depat1ment) to a request for public records. G. L. c. 66, § 1O A; see also 950 C.M.R. 32.08(1 ). Specifically, Mr. McDonagh requested records related to an identified incident and report. Subsequent to the opening of this appeal, you informed a Public Records Division staff member that the Department did not receive a copy of this request. I understand that this office provided the Department a copy oft)1e file associated with this appeal on December 3, 2018 and you indicated "[a]s of this date, the Department will treat it as a new FOIA request." Accordingly, the Depat1ment must provide a response to Mr. McDonagh in accordance with the Public Records Law and its Regulations within IO business days. Mr. McDonagh may appeal the substantive nature of the Department's response within 90 days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S.
