Assistant General Counsel Suffolk County Sheriffs Department 200 Nashua Street Boston, MA 02114 Dear Attorney Romero: I have received the petition from William McDonagh appealing the nonresponse of the Suffolk County Sheriffs Department (Depat1ment) to a request for public records. G. L. c. 66, § 1O A; see also 950 C.M.R. 32.08(1 ). Specifically, Mr. McDonagh requested records related to an identified incident and report. Subsequent to the opening of this appeal, you informed a Public Records Division staff member that the Department did not receive a copy of this request. I understand that this office provided the Department a copy oft)1e file associated with this appeal on December 3, 2018 and you indicated "[a]s of this date, the Department will treat it as a new FOIA request." Accordingly, the Depat1ment must provide a response to Mr. McDonagh in accordance with the Public Records Law and its Regulations within IO business days.
