Murray Supervisor ofR ecords December 1 7, 2018 SPR18/1871 Thomas Calter III To-wn of Kingston 26 Evergreen Street, Tovm Hall Kingston, MA 02364 Dear Mr. Calter: I have received the petition of Susan T. Munford appealing the nonresponse of the Town · of Kingston (Town) to a request for public records. G. L. c. 66, § lOA; see also 950 C.M.R. 32.08(1). Specifically Ms. Munford requested "all emails, sent and received by [an identified person] for the month of October 2016." Under the Public Records Law and the Access Regulations (Regulations) all requests for public records must be met with a response within ten business days of receipt of the request. G. L. c. 66, § lO(a)-(b ). The response may contain, among other things, an offer to provide records, a fee estimate for provision of the records, or a denial. G. L. c. 66, § 1O (b ). All records custodians must comply with both the Public Records Law and the Regulations with respect to the timeliness of response. Subsequent to the intervention by a member of the Public Records Division, this office was notified that on November 29, 2018, Thomas Calter III indicated "Susan. I was of the belief that your request was met. I will look into it this morning. Thanks." Accordingly, the Town is ordered to provide Ms. Munford with a response to the request, provided in a manner consistent with this order, the Public Records Law and its Regulations within 10 business days.
