Kelley Records Access Officer Kingston Police Department 244 Main Street Kingston, MA 02364 Dear Lt. Kelley: I have received the petition of Susan Munford appealing the response of the Town of Kingston (Town) to a request for public records. G. L. c. 66, § 1O A; see also 950 C.M.R. 32.08(1). Specifically, on November 20, 2018, Ms. Munford requested "copies of surveillance video for the station's entries and exits for Friday, November 2, 2018, from 4pm to midnight." The Town responded to her request on November 21, 2018, indicating "[t]he requested station surveillance video for the time frame you are requesting is no longer available." Ms. Munford appeals this response for a reason why the video is no longer available. Subsequent to the intervention by a member of the Public Records Division staff, this office was notified on December 11, 2018, that the Department has provided Ms. Munford with an explanation of why the video is no longer available, including that Ms. Munford was referencing an old retention schedule. Whereas this matter was opened based on the Town's November 21st response, I will now consider this administrative appeal closed. Ms. Munford may appeal the substantive nature of the Town's response within ninety days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S.
