Kelley Records Access Officer Kingston Police Department 244 Main Street Kingston, MA 02364 Dear Lt. Kelley: I have received the petition of Susan Munford appealing the response of the Town of Kingston (Town) to a request for public records. G. L. c. 66, § lOA; see also 950 C.M.R. 32.08(1). Specifically, Ms. Munford requested "a copy of the station surveillance video for the front entrance to the Police Station lobby on October 1, 2018 from 8pm to lOpm." The Town responded to her request on October 29, 2018 indicating "[t]he requested station surveillance video for the time frame you are requesting is no longer available." Ms. Munford appeals this response for a reason why the video is no longer available. Subsequent to the intervention by a member of the Public Records Division staff, this office was notified on December 11, 2018, that the Department has provided Ms. Munford with an explanation of why the video is no longer available, including that Ms. Munford was referencing an old retention schedule. Whereas this matter was opened based on the Town's October 29th response, I will now consider this administrative appeal closed. Ms. Munford may appeal the substantive nature of the Town's December 11, 2018, response within ninety days. See 950 C.M.R. 32.08(1 ). Sincerely, Rebecca S.
