Murray Supervisor ofR ecords February 5, 2019 SPR19/133 Bridget Connelly Department of Conservation and Recreation 251 Causeway Street Boston, MA 02114 Dear Attorney Connelly: I have received the petition of Elizabeth Foster appealing the nonresponse of the Department of Conservation and Recreation (Department) to a request for public records. G. L. c. 66, § lOA; see also 950 C.M.R. 32.08(1). Specifically on January 3, 2019, Ms. Foster requested, "any emails or other documentation regarding Wachusett Mountain Ski Area/WMA/Wachusett Mountain Associates." Ms. Foster further states, "I'm looking for documentation of instances when WMA would have not complied with state, local, or federal regulations or other rules, regulations, project specifications, or requirements in the operation of their business on State Land from 2005 to the present." I was informed a staff member of the Public Records Division notified you of this request. As of the date of this letter, it is my understanding that the Department has not provided Ms. Foster a response to her request for records. Order Accordingly, the Department is ordered to provide Ms. Foster with a response to the request, provided in a manner consistent with this order, the Public Records Law and its Regulations without delay.
