The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Rebecca S. Murray Supervisor ofR ecords February 11, 2019 SPR19/179 Shawn Williams, Esq. Director of Public Records City of Boston - Public Records 1 City Hall Square, Room 615 Boston, MA 02201 Dear Attorney Williams: I have received the petition of a client of Steven Brooks appealing the response of the City of Boston (City) to his request for public records. G. L. c. 66, § 1O A; see also 950 C.M.R. 32.08(1). Specifically, Attorney Brooks requested two categories ofrecords pertaining to "vending permits submitted to the City of Boston for the address 160 State Street, Boston, Massachusetts from 2008 to present." This request was the subject of previous appeals. See SPR18/611 Determination of the Supervisor of Records (May 16, 2018); SPR18/1373 Determination of the Supervisor of Records (September 26, 2018). This appeal petition asserts "[p] lease sen[ d] the app. for li[ c] # l 8-007R. .. " Subsequent to the intervention by a staff member of the Public Records Division, I learned that on December 6, 2018 Christopher Coakley of the City Public Works Department sent an email to Attorney Brooks that indicates "[p] lease see the attached vending permit applications for 160 State Street. I have also attached a letter from the Glynn Hospitality Group who are required to sign off on the permit as well." In an email to this office on February 8, 2018 you reference a request from a second lawyer and note "we provided responsive records to him as well. Again there are no other records." In light of the City's production of responsive applications, I will consider this appeal closed. Attorney Brooks may appeal the substantive nature of the City's response within 90 days. See 950 C.M.R. 32.08(1 ).
