Albert Ganem, Jr. Hampden-Wilbraham Regional School District 621 Main Street Wilbraham, MA 01095 Dear Supt. Ganem I have received the petition of Douglas Moser of NBC1 0 Boston appealing the nomesponse of the Hampden-Wilbraham Regional School District (District). Specifically on March 27, 2018, Mr. Moser requested various categories ofrecords concerning "relaxation, calm down, or time-out rooms." Under the Public Records Law and the Access Regulations (Regulations) all requests for public records must be met with a response within ten business days of receipt of the request. G. L. c. 66, § 1O (a)-(b ). The response may contain, among other things, an offer to provide records, a fee estimate for provision of the records, or a denial. G. L. c. 66, § 1O (b ). All records custodians must comply with both the Public Records Law and the Regulations with respect to the timeliness of response. Despite the intervention by a staff member of the Public Records Division, it is my understanding that the District has not provided Mr. Moser a response to his request for records. Accordingly, the District is ordered to provide Mr. Moser with a response to the request, provided in a manner consistent with this order, the Public Records Law, and it's Regulations without delay.
