Kenney Town Clerk and Records Access Officer 801 Washington Street Canton, MA 02021 Dear Ms. Kenney: I have received the petition of Richard Karp appealing the nonresponse of the Town of Canton (Town) to a request dated December 7, 2018 for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, Mr. Karp requested “communications regarding Open Start Times or Late Finish Times by the contractor at the Reservoir Dam Project.” The Town has indicated that they did not receive this request, though they did receive a request dated December 13, 2018 for the same records. In response to the December 13" request, they provided a fee estimate. Given that the December 7" and December 13" requests seek the same records, I will consider the response provided to the December 13" request by the Town a response to the December 7" request as well. Accordingly, I will now consider this administrative appeal closed, Mr. Karp may appeal the substantive nature of the Town’s response within ninety days. See 950 C.M.R. 32.08(1). Alorea faleeeo S.
