Murray Supervisor ofR ecords March 5, 2019 SPR19/415 Michael Jaillet Town Administrator Town of Westwood 580 High Street Westwood, MA 02090 Dear Mr. Jaillet: I have received the petition of Nada Milosavlgevic-Fabrizio appealing the response of the Town of Westwood (Town) to a request for public records. G. L. c. 66, § 1O A; see also 950 C.M.R. 32.08(1 ). Specifically, Ms. Milosavlgevic-Fabrizio requested: "copies of any and all documents presented by Michelle Miller, Procurement Manager, to each member of the Screening Committee for Legal Services prior to commencement of the Screening Committee for Legal Services' public hearing on February 7, 2019, including, but not limited to, any and all incidental and/or ancillary documents thereto." Open Meeting Law The Town responded to Ms. Milosavlgevic-Fabrizio on February 14, 2019 by asserting, "[your] request for these documents has been denied under M.G.L. Chapter 30A, § 22(e)(2) which exempts materials used in deliberations about employment or appointment including applications and supporting materials and M.G.L. Chapter 30B, § 6(d)." Please be advised that the interpretation of the Open Meeting Law falls within the authority of the Office of the Attorney General and not this office. Therefore, I decline to provide a determination as to the status of the any existing records responsive to Ms. Milosavlgevic Fabrizio request. See G. L. c. 30A, § 23. It is recommended that the parties contact the Division of Open Government within the Office of the Attorney General should they seek a determination on this issue.
