Deputy General Counsel Office of the General Counsel University of Massachusetts President's Office One Beacon Street, 31st Floor Boston, MA 02108 Dear Attorney Furth: I have received the petition of Dusty Christensen of the Daily Hampshire Gazette appealing the response of the University of Massachusetts -Amherst (UMass) to a request for public records. G. L. c. 66, § lOA; see also 950 C.M.R. 32.08(1). Specifically, on January 31, 2019, Mr. Christensen requested "[a ]ny correspondence - including but not limited to emails and their attachments -between the office of UMass Amherst Chancellor Kumble Subbaswamy and the office of Hampshire College President Miriam 'Mim' Nelson from 04/01/18 to 01/31/19." UMass provided responsive records on February 21, 2019 and noted that it withheld certain records under Exemption (d) of the Public Records Law and the attorney-client privilege. G. L. C. 4, § 7(26)(d). Subsequent to the opening of this appeal, UMass provided a response on March 7, 2019 in which it clarifies that no responsive documents were withheld. In a March 8, 2019 email, Mr. Christensen informed this office that he wishes to withdraw his appeal in light of this information. Accordingly, I will consider this appeal closed.
