Arata Administrative Secretary Berlin Board of Selectmen 23 Linden Street Berlin, MA 01503-1669 Dear Ms. Arata: I have received the petition from Attorney Alexander Furey appealing the nonresponse from Town of Berlin's Board of Selectmen (Board) to a request for public records. G. L. c. 66, § lOA; see also 950 C.M.R. 32.08(1). Specifically, Attorney Furey requested records which he had paid the fee to the Board but had not received. Subsequent to the intervention by a member of the Public Records Division staff, this office was provided with a subsequent response from the Board on March 7, 2019 which was provided to Attorney Furey. Based upon this response, I will now consider this administrative appeal closed. Attorney Furey may appeal the substantive nature of the Board's response within ninety days. See 950 C.M.R. 32.08(1).
