Murray Supervisor of Records April 2, 2019 SPR19/0635 Chief Patrick Swanick Wayland Police Department Town of Wayland 3 8 Cochituate Rd Wayland, MA 01778 Dear Chief Swanick: I have received the petition of Pat Bender appealing the nonresponse of the Wayland Police Department (Department) to a request for public records. G. L. c. 66, § 1O A; see also 950 C.M.R. 32.08(1). Specifically, Mr. Bender requested "disclosure of your police department's <March 5, 2019> daily log." Having received no response, Mr. Bender petitioned this office. Subsequent to the intervention by a staff member of the Public Records Division, I learned that the proper agent for handling public record requests never saw the inquiry. Nonetheless, the Department indicated they were working with their Town Administrator to provide Mr. Bender with a response. Said response must be made in accordance with the Public Records Law and its Access Regulations within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Bender may appeal the substantive nature of the Department's response within ninety days.
