Staff Counsel Office of the Chief Legal Counsel Massachusetts State Police 470 Worcester Road Framingham, MA 01702 Dear Attorney DeAngelis: I have received the petition of Darius Gibson appealing the nonresponse of the Massachusetts Department of State Police (Department) to his requests for public records. G. L. c. 66, § lOA; see also 950 C.M.R. 32.08(1). Specifically, on March 19, 2019 Mr. Gibson requested three categories of records pertinent to reports authorized by several identified individuals, various documents concerning gloves, and identified sections of crime scene reports (SPRl 9/771 ). On March 21, 2019, Mr. Gibson made a request for the same material to a separate custodian within the Department (SPR19/772). Claiming to not yet have received a response from either recipient, Mr. Gibson petitioned this office and these appeals were opened as a result. Despite being notified of the opening of these appeals and communication from a staff member of the Public Records Division, it remains unclear whether the Department has provided a response to eithei; request. As such, the Department is ordered to provide Mr. Gibson with a written response. Said response shall be made in accordance with the Public Records Law, its Access Regulations and this order within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Gibson may appeal the substantive nature of the Police's responses within ninety days.
