Dear Ms. Bouchard:

I have received the petition of Tim McGuire appealing the nonresponse of the City of Fall River - Office of the City Clerk (City) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, Mr. McGuire requested the most recent reports concerning the quality of Fall River’s municipal water supply submitted to the Environmental Protection Agency and to the Massachusetts Department of Environmental Protection.

Subsequent to the intervention by a member of the Public Records Division, I learned that the City provided Mr. McGuire with a response to his request. Mr. McGuire emailed this office on May 4, 2019 indicating that he wished to withdraw his administrative appeal. Accordingly, I will now consider this appeal closed.
