Assistant General Counsel Executive Office of Public Safety and Security One Ashburton Place, Room 2133 Boston, MA 02108 Dear Attorney Mullaney: I have received the petition of J.D. Carrier appealing the nonresponse of the Executive Office of Public Safety and Security (EOPSS) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, Mr. Carrier requested two identified documents, as well as correspondence regarding one of the aforementioned records. Claiming to not yet have received a response, Mr. Carrier petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that the proper agent for handling public record requests never saw the inquiry. Nonetheless, I learned a response had been provided dated May 1, 2019. Whereas the basis of this appeal was opened as a result of EOPSS’ failure to provide a written response, I will now consider this administrative appeal closed.
