Records Access Officer Office of the General Counsel Massachusetts Department of Transportation Ten Park Plaza, Suite 3510 Boston, MA 02116 Dear Attorney Doyle: I have received the petition of Attorney Lucas Newbill appealing the nonresponse of the Massachusetts Department of Transportation (MassDOT) to a request for public records. G. L. ¢. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, Attorney Newbill requested “copies of all records examined and/or created in responding ...” to a previous request for records made to MassDOT. Claiming to not yet have received a response, Attorney Newbill petitioned this office and this appeal was opened as a result. , Subsequent to the intervention by a staff member of the Public Records Division, I learned that a representative from MassDOT intends on providing Attorney Newbill with a written response to his request. Accordingly, MassDOT is ordered to provide Attorney Newbill with a response made in accordance with the Public Records Law, its Access Regulations and this order within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Wallack may appeal the substantive nature of MassDOT’s response within ninety days.
