G. L. c. 66, § IOA; see also 950 C.M.R. 32.08(1). Specifically, Mr. Powers requested "reports related to the hiring background investigation and to the internal affairs investigation ... " of an identified individual. Claiming to not yet have received a response, Mr. Powers petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that the Department responded to Mr. Powers' request with a response sent on May 10, 2019. Whereas the basis of this appeal was opened as a result of the Department's failure to provide a written response, I will now consider this administrative appeal closed. Mr. Powers may appeal the substantive nature of the Department's response within ninety (90) days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S.
