Records Access Officer Hampden County District Attorney's Office 50 State Street Springfield, MA 01102 Dear Attorney Pessolano: I have received the petition ofNhut Huynh appealing the nonresponse of the Hampden County District Attorney's Office (DAO) to a request for public records. G. L. c. 66, § lOA; see also 950 C.M.R. 32.08(1). Specifically, Mr. Huynh requested an index related to a case file. Claiming to not yet have received a response, Mr. Huynh petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that the proper agent for handling public record requests never saw the inquiry. Nonetheless, after the DAO was made aware of this appeal, a representative within the DAO noted their willingness to provide a response. Accordingly, the DAO is ordered to provide Mr. Huynh with a written response. Said response shall be made in accordance with the Public Records Law, its Access Regulations and this order within ten business days. It is preferable to send an electronic copy ofthisresponse to this office at pre@sec.state.ma.us. Mr. Huynh may appeal the substantive nature of the DAO's response within ninety days.
