G. L. c. 66, § lOA; see also 950 C.M.R. 32.08(1). Specifically, Mr. Ristuccia requested "Video from MBTA Bus #0657 (Route 79) on April 23, 2019 between 6:45 and 7 p.m." Claiming to not yet have received a response, Mr. Ristuccia petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that a representative from the MBTA intends on providing Mr. Ristuccia with a written response to his request. Accordingly, the MBTA is ordered to provide Mr. Ristuccia with a · response made in accordance with the Public Records Law, its Access Regulations and this order within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Ristuccia may appeal the substantive nature of the MBTA's response within ninety days.
