Corporation Counsel City of Fall River One Government Center Fall River, MA 02722 Dear Judge Macy: I have received the petition of Colman Herman appealing the nonresponse of the Fall River Corporation Counsel (Counsel) to a request for public records. G. L. c. 66, § lOA; see also 950 C.M.R. 32.08(1). Specifically, Mr. Herman requested a more legible copy of a record that had previously been provided by the Counsel. Claiming to not yet have received a response, Mr. Herman petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that the proper agent for handling public record requests never saw the inquiry. Nonetheless, after the Counsel was made aware of this appeal, a representative within the Counsel noted their willingness to provide a response addressing the concerns that Mr. Herman outlined in his appeal. Accordingly, the Counsel is ordered to provide Mr. Herman with a response within ten business days. Said response shall be made in accordance with the Public Records Law, its Access Regulations and this order within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Herman may appeal the substantive nature of the Counsel's response within ninety days. See 950 C.M.R. 32.08(1).
