Records Access Officer Massachusetts Bay Transportation Authority Ten Park Plaza, Suite 7760 Boston, MA 02116 Dear Attorney Ciollo: I have received the petition of Friedrich Lu appealing the nonresponse of the Massachusetts Bay Transportation Authority (MBTA) to a request for public records. G. L. c. 66, § lOA; see also 950 C.M.R. 32.08(1). Specifically, Mr. Lu requested two categories ofrecords concerning an identified MBTA location. Claiming to not yet have received a response, Mr. Lu petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that the MBTA responded to Mr. Lu's request with a response sent on April 29, 2019. Whereas the basis of this appeal was opened as a result of the MBTA's failure to provide a written response, I will now consider this administrative appeal closed. Mr. Lu may appeal the substantive nature of the MBTA's response within ninety (90) days. See 950 C.M.R. 32.08(1). Sincerely, ~ Rebecca S.
