Staff Counsel Massachusetts State Police 4 70 Worcester Road Framingham, MA 01702 Dear Attorney DeAngelis: I have received the petition of Marc Aldana appealing the nonresponse of the Department of State Police (Department) to a request for public records. G. L. c. 66, § 1O A; see also 950 C.M.R. 32.08(1 ). Specifically, Mr. Aldana requested "[a ]11 police reports of ... " an identified individual "pertaining to thermite." Claiming to not yet have received a response, Mr. Aldana petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that the Department responded to Mr. Aldana's request with a response sent on May 20, 2019. Mr. Aldana contacted an agent of this office after receiving the Department's aforementioned response, noting dissatisfaction with the substantive content. Consequently, a subsequent appeal has been opened to address Mr. Aldana's concern(s) (SPR19/981). Whereas the basis of this appeal was opened as a result of the Department's failure to provide a written response, I will now consider this administrative appeal closed.
