Deputy Chief Legal Counsel Massachusetts State Police 470 Worcester Road Framingham, MA 01702 Dear Attorney Farrell: I have received the petition of Antonio Alves appealing the nonresponse of the Department of the State Police (Department) to a request for public records. G. L. c. 66, § 1 OA; see also 950 C.M.R. 32.08(1). Specifically, Mr. Alves requested "all dash cam history, all GPS history ... " of a Department vehicle during an identified incident. Claiming to not yet have received a response, Mr. Alves petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that the proper agent for handling public record requests never saw the inquiry. Nonetheless, after the Department was made aware of this appeal, a representative within the Department noted their willingness to provide a response. Accordingly, the Department is ordered to provide Mr. Alves with a response within ten business days. Said response shall be made in accordance with the Public Records Law, its Access Regulations and this order within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Alves may appeal the substantive nature of the Department's response within ninety days. See 950 C.M.R. 32.08(1).
