Box 1218 Shirley, MA O1 464 Dear Ms. Kingman: I have received the petition of Robert W. Anderson, Jr. appealing the response of the Department of Correction - MCI Shirley (Department) to a request for public records. G. L. c. 66, § lOA; see also 950 C.M.R. 32.08(1). Specifically, on April 10, 2019, Mr. Anderson requested the following categories of records: a) Religious Services Handbook (February 2019); b) Religious Services Handbook (Most Recent Edition); c) 103 CMR 471.000 (et seq.): Religious Programs & Services; d) 130 CMR 485.000 (et. seq.): Volunteer and Volunteer Programs; e) 103 DOC 522.000 (et. seq.): Internal Affairs Unit; and, f) Any MCI Shirley Procedures for the above regulations/policies. In its April 23rd response, the Department indicates that it has provided Mr. Anderson with "a copy of the Religious Handbook, 103 CMR 485, and 103 CMR 471." The Department states that it is denying Mr. Anderson's "103 DOC 522" request "under the security ("n") exemption in M.G.L. c. 4, § 7, cl. 26(n). Information regarding the policy and procedures of the Internal Affairs Unit should not be given to for security reasons." While this appeal was pending, the Department provided Mr. Anderson with another response dated June 4, 2019 which included a copy of the 103 DOC 522 policies. Whereas this appeal was opened based on the Department's April 23rd response; specifically its withholding of the 103 DOC 522 policies, I decline to opine on this appeal. Accordingly, I will now consider this administrative appeal closed. Mr. Anderson may appeal the substantive nature of the Department's June 4th response within ninety days. See 950 C.M.R. 32.08(1).
