G. L. c. 66, § 1O A; see also 950 C.M.R. 32.08(1). Specifically, Mr. Kath requested a "contract or agreement ... " within the Town's possession concerning an investigation. Claiming to not yet have received a response, Mr. Kath petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that the Town responded to Mr. Kath's request with a response sent on May 28, 2019. Whereas the basis of this appeal was opened as a result of the Town's failure to provide a written response, I will now consider this administrative appeal closed. Mr. Kath may appeal the substantive nature of the Town's response within ninety days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S.
