Murray Supervisor ofR ecords May 29, 2019 SPR19/1068 Rose Marie Blackwell City Clerk City of Taunton 141 Oak Street Taunton, MA 02780 Dear Ms. Blackwell: I have received the petition of Kate McPherson of Save the Bay appealing the nonresponse of the City of Taunton (City) to a request for public records. G. L. c. 66, § lOA; see also 950 C.M.R. 32.08(1). Specifically, Ms. McPherson requested three categories ofrecords concerning "all funds spent or encumbered and any contracts entered into in connection with, or related to, the City of Taunton's NPDES permit appeals and requests for modification in all forums of the City's 2015 wastewater treatment National Pollutant Discharge Elimination System (NPDES) permit issued by the United States Environmental Protection Agency (EPA) from 2015 to the present ... ". Claiming to not yet have received a response, Ms. McPherson petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that the City has multiple agents working to gather responsive documents and provide them without delay. In the meantime, a representative of the City indicated their willingness to provide a written response to Ms. McPherson. Accordingly, the City is hereby ordered to provide a written response within ten business days. Said response shall be made in accordance with the Public Records Law, its Access Regulations and this order within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Ms. McPherson may appeal the substantive nature of the City's response within ninety days. See 950 C.M.R. 32.08(1).
