Records Access Officer Massachusetts Bay Transportation Authority Ten Park Plaza, Suite 7760 Boston, MA 02116 Dear Attorney Ciollo: I have received the petition of Brian Ristuccia appealing the response of the Massachusetts Bay Transportation Authority (MBTA) to a request for public records. G. L. c. 66, § IOA; see also 950 C.M.R. 32.08(1). Specifically, Mr. Ristuccia requested video footage from two MBTA busses during an identified timeframe. Unsatisfied with the MBTA's response in which they claimed they are not in possession of any responsive records, Mr. Ristuccia petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that a representative from the MBTA intends on proving a supplemental written response to Mr. Ristuccia aimed at addressing the concern(s) outlined in his latest appeal. Accordingly, the MBTA is ordered to provide Mr. Ristuccia with a response in accordance with the Public Records Law, its Access Regulations and this order within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Ristuccia may appeal the substantive nature of the MBTA's response within ninety days. See 950 C.M.R. 32.08(1).
