G. L. c. 66, § lOA; see also 950 C.M.R. 32.08(1). Specifically, Ms. Carito requested monthly reports, change orders/extra work orders, and a "Schedule Update Narrative" all concerning the "Barletta Heavy Division Casey Arborway." Claiming to not yet have received a response, Ms. Carito petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that a representative from MassDOT intends on proving a written response to Ms. Carito. Accordingly, MassDOT is ordered to provide Ms. Carito with a response in accordance with the Public Records Law, its Access Regulations and this order within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Ms. Carito may appeal the substantive nature ofMassDOT's response within ninety days.
