Records Access Officer Massachusetts Department of Transportation Ten Park Plaza, Suite 3910 Boston, MA 02116 Dear Attorney Doyle: I have received the petition of Michelle Loubert appealing the nomesponse of the Massachusetts Department of Transportation (MassDOT) to a request for public records. G. L. c. 66, § lOA; see also 950 C.M.R. 32.08(1). Specifically, Ms. Loubert requested a rating assessment for a bridge in Great Barrington, MA. Claiming to not yet have received a response, Ms. Loubert petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that MassDOT responded to Ms. Loubert' s request with a response sent on June 24, 2019. Furthermore, Ms. Loubert contacted this office confirming her "request has been fulfilled." Whereas the basis of this appeal was opened as a result of MassDOT' s failure to provide a written response, I will now consider this administrative appeal closed. Ms. Loubert may appeal the substantive nature of MassDOT's response within ninety days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S.
