Box 807 Middleton, MA 01949 Dear Attorney Sullivan: I have received the petition of Andrew Quemere appealing the response of the Essex County Sheriffs Office (Office) to a request for public records. G. L. c. 66, § lOA; see also 950 C.M.R. 32.08(1). Specifically, Mr. Quemere requested material within the possession of the Office relating to fentanyl and carfentanil. The office provided a response on May 23, 2019 which provided responsive records, but also commented on the "ambiguity" of Mr. Quemere' s request. Mr. Quemere responded to the Office via email asking what aspect of his request was ambiguous and how he could clarify to avoid omission of any other pertinent records. Claiming to not yet have received a response, Mr. Quemere petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that a representative from the Office intends on proving a written response to Mr. Quemere addressing the concern outlined in his appeal. Accordingly, the Office is ordered to provide Mr. Quemere with a response in accordance with the Public Records Law, its Access Regulations and this order within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Quemere may appeal the substantive nature of the Office's response within ninety days. See 950 C.M.R. 32.08(1).
