Records Access Officer Massachusetts Bay Transportation Authority Ten Park Plaza, Suite 7760 Boston, MA 02116 Dear Attorney Ciollo: I have received the petition of Michael Dreslinski appealing the nonresponse of the Massachusetts Bay Transportation Authority (MBTA) to a request for public records. G. L. c. 66, § lOA; see also 950 C.M.R. 32.08(1). Specifically, Mr. Dreslinski requested three categories of records he believes are in the possession of the MBTA. Claiming to not yet have received a response, Mr. Dreslinski petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that a representative from the MBTA intends on proving a written response to Mr. Dreslinski, as well as any responsive records within the MBTA's possession. Accordingly, the MBTA is ordered to provide Mr. Dreslinski with a response in accordance with the Public Records Law, its Access Regulations and this order within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Dreslinski may appeal the substantive nature of the MBTA's response within ninety days. See 950 C.M.R. 32.08(1).
