The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Rebecca S. Murray Supervisor ofR ecords June 21, 2019 SPR19/1244 Shawn A. Williams, Esq. Records Access Officer Director of Public Records City of Boston 1 City Hall Plaza, Room 615 Boston, MA 02201 Dear Attorney Williams: I have received the petition of Michael Dreslinski appealing the nomesponse of the City of Boston's Public School System (City) to a request for public records. G. L. c. 66, § lOA; see also 950 C.M.R. 32.08(1). Specifically, Mr. Dreslinski requested a copy of a "[c]ivil [c]omplaint (lawsuit) filed against Boston Public School Department (BPS) in 2018 alleging BPS improperly provided certain information/records to federal immigration agencies and/or Immigration and Customs Enforcement (ICE)". Claiming to not yet have received a response, Mr. Dreslinski petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that the proper agent for handling public record requests never saw the inquiry. Mr. Dreslinski should note that the Records Access Officer for the City of Boston is as follows: Shawn A. Williams, Esq. Records Access Officer Director of Public Records City of Boston 1 City Hall Plaza, Room 615 Boston, MA 02201 Nonetheless, after the City was made aware of this appeal, a representative within the City noted their willingness to provide a response. Accordingly, the City is ordered to provide Mr. Dreslinski with a response within ten business days. Said response shall be made in accordance with the Public Records Law, its Access Regulations and this order within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Dreslinski may appeal the substantive nature of the City's response within ninety days.
