The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Rebecca S. Murray Supervisor of Records July 12, 2019 SPR19/1305 Timothy Luff Assistant Superintendent Office of Student Services Natick Public Schools 13 East Central Street Natick, MA 01760 Dear Mr. Luff: I have received the petition of Corey Spaulding appealing the response of Natick Public Schools (School) to a request for public records. G. L. c. 66, § 1O A; see also 950 C.M.R. 32.08(1 ). Specifically, Ms. Spaulding requested information concerning evidence of a "residency investigation." This request is related to the subject ofa previous appeal. See SPR19/1188 Determination of the Supervisor of Records (June 18, 2019). Under the Public Records Law and the Access Regulations (Regulations) all requests for public records must be met with a response within ten business days of receipt of the request. G. L. c. 66, § lO(a)-(b). The response may contain, among other things, an offer to provide records, a fee estimate for provision of the records, or a denial. G. L. c. 66, § lO(b). All records custodians must comply with both the Public Records Law and the Regulations with respect to the timeliness of response. Subsequent to the filing of this appeal, this office was notified that the School provided responses on June 27, 2019 and June 28, 2019 aimed at ad.dressing the concerns raised in the appeal. In a July 11, 2019 email Ms. Spaulding noted that with respect to the records at issue, she " ... filed in Superior Court which I feel is a necessary venue." In light of the School's June 27th and June 28th responses, as well as Ms. Spaulding's indication that she filed a lawsuit in this matter, I will now consider this administrative appeal closed. See 950 C.M.R. 32.08(2)(b). s ~ Rebecca S.
