Records Access Officer Massachusetts Department of Transportation Ten Park Plaza, Suite 3510 Dear Attorney Doyle: I have received the petition of Heather Cari to appealing the nonresponse of the Massachusetts Department of Transportation (MassDOT) to a request for public records. G. L. c. 66, § JOA; see also 950 C.M.R. 32.08(1). Specifically, Ms. Carito requested three categories of records within the possession of MassDOT concerning civil engineering. Claiming to not yet have received a response, Ms. Carito petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I leamed that MassDOT responded to Ms. Carito's request with a response sent on July 12, 2019. Whereas the basis of this appeal was opened as a result of Mass DOT' s failure to provide a written response, I will now consider this administrative appeal closed. Ms. Carito may appeal the substantive nature of MassDOT's response within ninety days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S.
