The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Rebecca S. Murray Supervisor ofR ecords July 11, 2019 SPR19/1363 Anthony Zeoli City Clerk City of Brockton 45 School Street Brockton, MA 02301 Dear Mr. Zeo Ii: I have received the petition ofBeajamin Berke of The Enterprise appealing the nonresponse of the City of Brockton (City) to a request for public records. G. L. c. 66, § lOA; see also 950 C.M.R. 32.08(1 ). Specifically, Mr. Berke requested a copy of a "certificate of fitness policy." Claiming to not yet have received responsive records, Mr. Berke petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that Mr. Berke contacted this office noting that he had "received a satisfactory response" to his request for records. Whereas the basis of this appeal was opened as a result of the City's failure to provide responsive records, I will now consider this administrative appeal closed. Mr. Berke may appeal the substantive nature of the City's response within ninety (90) days. See 950 C.M.R. 32.08(1). Sincerely, ~~ Rebecca S.
